1. Agreement to these terms
These Terms form a binding agreement between you and IT Monks Sp. z o.o., the operator of MailStrike ("MailStrike", "we", "us"). By creating an account, connecting a mailbox, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
MailStrike improves email sending reputation by generating message content on its backend, sending that content from connected mailboxes, and adjusting the placement of those messages, including moving them out of the spam folder. MailStrike does not send your campaign mail and does not store the existing contents of your mailbox.
3. Accounts
You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account. Notify us promptly at hello@mailstrike.ai if you suspect unauthorised use. You must be at least 16 years old to use the Service.
4. Connected Gmail and other mailboxes
The Service connects to your mailbox to provide warmup. For Google mailboxes it uses the gmail.modify permission to send messages and relabel those same messages. We do not permanently delete your mail, and we do not store your existing mailbox contents. Our use of Google user data complies with the Google API Services User Data Policy, including its Limited Use requirements, and Google user data is not used to develop, improve, or train generalised artificial intelligence models, and is not transferred to third-party AI services. You can revoke our access to your mailbox at any time.
5. Acceptable use
You must use the Service in line with our Acceptable Use Policy at https://www.mailstrike.ai/aup, which forms part of these Terms.
6. Fees and billing
Paid plans are offered on monthly, quarterly, and annual billing cycles, as shown at checkout. Fees are billed in advance for each cycle. Unless you cancel, your subscription renews automatically at the end of each cycle for a further period of the same length, at the then-current price. You can cancel at any time; on cancellation your access continues until the end of the paid period then in progress, and you are not charged for the next period. Except where required by law, fees are non-refundable. Payments are processed by Stripe.
7. Free trial
Where we offer a free trial, a valid payment method is required at signup. The trial lasts 7 days unless we state otherwise. At the end of the trial your subscription automatically converts to a paid plan on the cycle you selected, and your payment method is charged, unless you cancel before the trial ends. You can cancel during the trial at any time from your account or by contacting hello@mailstrike.ai.
8. Business customers only
MailStrike is offered only to businesses and to individuals acting for purposes relating to their trade, business, craft, or profession. By creating an account you confirm you are not acting as a consumer, and consumer-protection rules, including any statutory 14-day right of withdrawal, do not apply to your use of the Service. If you are acting as a consumer, do not use the Service.
9. Intellectual property
MailStrike owns the Service and all related intellectual property. You retain ownership of the data and content you provide. You grant us the rights needed to process that data in order to provide the Service.
10. Privacy, Acceptable Use, and Data Processing
Our handling of personal data is governed by our Privacy Policy at https://www.mailstrike.ai/privacy, which forms part of these Terms. Your use of the Service is also subject to our Acceptable Use Policy at https://www.mailstrike.ai/aup. Where we process personal data on your behalf, our Data Processing Agreement at https://www.mailstrike.ai/dpa applies and forms part of these Terms.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee any specific deliverability outcome or inbox placement, which depend on factors outside our control, including your domain, content, sending behaviour, and the policies of mailbox providers.
12. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, or if required to protect the Service or comply with law. On termination, your data is deleted or anonymised in line with our Privacy Policy.
14. Changes to these terms
We may update these Terms from time to time. We will communicate material changes by email or through the Service before they take effect. Your continued use of the Service after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. The courts competent for the registered seat of IT Monks Sp. z o.o. in Kraków, Poland have exclusive jurisdiction, except where mandatory consumer-protection law gives a consumer the right to bring proceedings in their country of residence.
16. General
Assignment. You may not assign or transfer these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, and, where applicable, the Data Processing Agreement, are the entire agreement between you and us regarding the Service.
Severability. If any provision is held unenforceable, the rest remain in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
